The need of an immigration lawyer

Every one wants to get a US Green Card, but who will achieve it smoothly? The correct answer is, no, not, “The lucky ones”; it is “The people who hire an able and experienced immigration attorney.”
Immigration attorney is a person who advices people in legal matters related to immigration. He will represent his clients in courts of law; he will talk and negotiate with ICE officers and USCIS people.

Immigration lawyers are helpful in dealing with all types of immigration petitions, visas and, including H1B visas, investor visas, family residency and employment-based permanent residency visas. They also assist with citizenship or naturalization, visa waivers, immigration court proceedings, religious visas, and deportation hearings. In general these lawyers work in private firms. Some of them also provide legal services individually. Some others work on a contingency fee basis. Experienced immigration lawyers are employed by the government to work at the, state, or federal level, depending on their expertise and experience.

Some attorneys offer legal advice. They only prepare parts of a case and leave the total presentation to the clients themselves. In particular cases, lawyers may be limit themselves to advising part only. Generally, in such cases, the attorneys do not represent the client in court. This type of practice is accepted by American Bar Association as well.

The immigration issues can be broadly categorized in to Business/Employment issues, Family Reunification and Naturalization issues, Deportation Defense issues, and Litigation and Appeals. The business organizations and the individuals seeking visas, applied for citizenship, residency or relief from detention and deportation proceedings need the services of an experienced immigration attorney. Technically any one can handle his own case without help of an attorney, but it is always better to have an expert on your side. The immigration lawyers thoroughly examine the facts and help the clients to prepare comprehensively for any hearing or interview by USCIS.

It is a common fact that normal people or confused by the red tape and bureaucracy involved in immigration procedures. This confusion may cause fatal errors which can be avoided by the help of an attorney. The expert legal services also resolve addressing delays or incorrect interpretations of immigration laws and regulations in the Federal courts to obtain favorable results.

Generally law firms have specialist staff in different areas and if necessary they form an expert team to fight a particular case. Big firms have some influence in courts as their lawyers are well-known to judges all over the country. These firms handle all aspects of immigration practice including appeal for appraisal in detention issues, Writs of Habeas Corpus, filing review petitions asking mandamus for unpardonable USCIS delays and class action lawsuit.

People without valid documents face very embarrassing situations in US. They have to live in constant fear of raids and arrest by the ICE. Prepares them with Do’s and Don’t‘s in dealing with ICE agents. An experienced immigration lawyer can find out the holding place of detainee with the help of his “A number” and name. He can speak to the ICE agent in charge; negotiate with him to release the detainee, with or without a bond.
